Yes, Murat, I agree with you. The Greek Cypriot 'adminstration' in the south has no right to speak on behalf of the Turkish Cypriots, who thanks to Turkey, are now living in peace and away from the ethnic cleansing that would have taken place but for the timely Turkish intervention. My personal view is that the vast majority Greek Cypriots, despite their rethoric on the international forums, still see Cyprus as a 'Greek' island with a small ethnic minority that is being awkward. So long as that attitude remains,the status quo will remain for the foreseeable future.

North Cyprus should ignore this ruling, but agree to pay some reasonable compensation to the previous owner as they did provide the deeds and legal documentation for this property. The couple themselves are totally innocent. The fact that the Greek people lost their property in 1974 was an injustice, but this is just injustice heaped on injustice. There needs to be a better solution. Also, if I was part of a North Cyprus government , I would give two fingers and "mind your own business" to a British court decision in relation to my country....but maybe I am more biased because I am Irish!

Your article talks about "disputed" land. There is no dispute. The ECHR, the ECJ, the UK High Court and the UK Court of Appeal have all confirmed and re-affirmed that the title deeds issued by the TRNC are completely worthless and that the original Greek Cypriot owners remain the owners of the title. Only the delusional or fraudulent can claim there to be any doubt on the matter. As to the statement that there cannot be 800 cases, why not? I am personally preparing 12 cases and other lawyers I know have between them another 50 or so. I imagine there are many more. As for Ed Smith's nonsense I don't really care where the illegal immigrants in the North go, they shouldn't be living in nother people's homes. The Turkish Cypriots displaced from the south of the island are welcome to recover their homes and properties in the Republic of Cyprus as many already have. As for Mr Smith he should start checking his title deeds in the Occupied Area and if he has any property within the EU he should start to panic.

This is all nonsense..the Cyprus problem is solved already along the lines of the current division.There is no turning back and lets drop the injustices inflicted on both sides.The way forward is for the original deeds held on both sides and used in the North for property exchange [known as esker deeds] to be put into a pot and compensation paid out accordingly. The political impasse will soon be history as a velvet divorce is established between the two sides on Cyprus.Turkey will almost certainly not join the EU and knows this only too well.The UK needs to examine carefully the implications of "supreme" EU law .Actually the EU faces huge internal difficulties as countries like Greece,Portugal etc are finally having to face up to debts that are out of control and the eurozone may yet collapse.So its better to not too boast too much about how much Turkey will have to pay to the "World" as some of the writers here predict.

They and thousands of others have paid Millions of pounds sterling for properties that they haven't got and were never designed to get. Receiving stolen property is illegal anywhere in the world. There are no if''s buts or maybes. Usually thieves do their dirty work in the middle of the night when no one can see them. These people are doing it in bright daylight in sight of the whole world and try to hide behind what began as a "peace operation" and ended up a a screen for ethnic cleansing and abuse of human rights on a massive scale. IT IS IMPOSSIBLE, I repeat IMPOSSIBLE for these people not to have known what they were doing. Their "advisers" are even worse because they duped them into thinking they could get away with it. All Cypriots (TC's and GC's) should know that as EU citizens they now have access to the real rule of law, in the EU. It is in their best interest and that of their people and their country, to pursue justice for all the wrongs that have been done to them in any way they can. Their leaders (and where applicable those that pull their strings in the background) should also remember that playing games at their expense (as they have been doing for the past 50-60) is no longer acceptable. They should forget the lies, manipulation, propaganda and their own selfish interests and come up with a realistic solution that is acceptable to ALL THE CYPRIOTS, because these Cypriots now have a weapon that sooner or later will defeat even the worlds strongest army. UNADULTERATED LAW, as applied where the Rule of Law is the way of life. MAY ALL THE CYPRIOTS FIND AND LIVE IN REAL PEACE

Property taken away by force has to be returned to the legal owners with compensation for lack of use over so many years. This should apply both to Greek and Turkish Cypriots. The foreigners who took opportunity to benefit from the tragedy of the masses of Greek and Turkish Cypriots who were forced to abandon their properties they have to pay a price too. Giving the property rights back to the legal owners may create an initial chaos but it will bring justice that is fundamental for a workable solution to the political problem.

The real loser in this case is Turkey's 35 year effort to legitimize ethnic division on Cyprus. The rest of the world has not accepted this view or approved of the violation of international law as represented by the 35 year military occupation of north Cyprus-80% of which land is owned by Greek Cypriots according to some sources. The Orams case is just the beginning, many thousands more cases wait to be ejudicated. Damages assessed against Turkey for preventing Greek Cypriot owners from access to their property could result in Billions of EURO's in settlements-Turkey being required to abide by EU Court Decisions. In retrospect it was foolish for Turkey's political and military leadership to flout international law so brazenly on Cyprus. UN resolutions were quite clear on the unacceptability of the military occupation way back in the mid 1970s'.

Where does Europe and the UK expect the near 300,000 residents of Northern Cyprus to go? Secondly, have the Greek Cypriots forgotten about the Turkish army? Do they really want another 1974? This case will actually take us back 10 years with the likely outcome being: 1. The borders being shut 2. Talat losing the election 3. The new Turkish Cypriot government ending talks with Greek Cypriots If the Greek Cypriots are willing to see their beaches turn red with blood then let them proceed. The Turkish Cypriots will never again be second class citizens they would rather die fighting.

One day the foreigners trespassing on Greek Cypriot properties will turn against the illegal Turkish occupation regime in the north and sue them, Turkey or both, especially when they realise the title deeds they were issued are not worth the paper they are written on. Alternatively, the occupation regime will drop you like a hot potato and remove the squatters at the expense of a solution that will eventually allow Greek Cypriots to return. British and European occupiers of Greek-Cypriot homes in the north, you are going to lose everything, and when you least expect it, you will receive a summons to appear in the courts of the Republic of Cyprus.

Life in the North should come to a halt, but not in the South while the pretense of negotiations stretches to eternity! That is not the way to win people over and come to an agreement. This is about hate and animosity. Good job EU! TRNC wil be there for a long long time it seems. All should get used to it.

The essence of the Oram case is that judgements of Cypriot courts, whose jurisdiction includes the entire island, can be enforced in EU member states. A practical application of this would be, let's say a Turkish Cypriot having an accident with a German tourist who is at fault. Before the Oram case the tourist could flee out of Cyprus and by the time the Cypriot court judgement came down in favor of the TC plaintiff, there would be no practical way of enforcing the judgement. What the Oram case did is that now the TC can enforce the judgement of the Cypriot court in Germany, provided that the German defendant has assets that a judgement can be attached to and subsequently collected. As far as the example of the manager's father case in Limassol, the statement "he had to stay six months in the south before applying" does not make any sense to me. No one has to stay for any period of time. Typically the attorney representing you will file the case with the appropriate court and follow through...I have never heard of a case requiring residency for a given period...this is all some nonsense designed to invoke undeserved sympathy.
